These Terms of Use (the "Terms") govern your use of ameritexnotary.com (the "Site"), which is operated by AmeriTex Notary LLC ("AmeriTex," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
What this Site is, and what it is not
- The Site describes AmeriTex's mobile and remote online notary and closing services, and lets you request a quote, ask a question, or ask about becoming a partner company.
- AmeriTex is not a law firm. We are not your attorney, lender, title insurer, or escrow agent, and nothing on the Site is legal, tax, financial, or loan advice.
- Notaries public are not attorneys. A notary may not give legal advice, explain the legal effect of a document, or recommend whether you should sign it. Questions about your documents or loan terms belong with your attorney, lender, or title company.
- Information on the Site about identification, devices, platforms, timing, fees, and eligibility is general. It can change by state, platform, lender, underwriter, and county recorder, and it does not replace the instructions you receive for a specific transaction.
Requests sent through the Site
- A request is not an order. Sending the form on the Site does not place an order, schedule a signing, or create a contract. We accept orders only through our scheduling channels, which clients receive after onboarding.
- Quotes are estimates. A quote is based on the information you give us and is valid only as stated in the quote. It may change if the file, location, signers, timing, or document package changes.
- Each assignment has its own terms. Fees, cancellation, rescheduling, and trip charges are set in the quote, order confirmation, or client agreement for that assignment. If those documents conflict with these Terms, they control for that assignment.
- Accurate information only. You agree that what you send us is accurate and that you have the right to share it.
- Do not send sensitive data through the form. Do not include Social Security numbers, images of identification, bank or account numbers, or loan documents in a Site request. We will tell you how to send those securely if they are needed.
Our services depend on law and on other parties
- Notarial acts are performed by commissioned notaries public under the laws of the state that commissioned them. A notary may refuse or stop a notarization when required by law, or when a signer's identity, willingness, or awareness cannot be established.
- Remote online notarization depends on state law, the platform used, and acceptance by the lender, underwriter, and county recorder. We do not guarantee that any document will be accepted for recording or funding.
- Service is not guaranteed for every location, date, or time. We generally cover most populated areas, but where notary availability is limited, in rural or populated areas, we may need more lead time or ask to meet at an alternative location.
- We are not responsible for delays or failures caused by carriers, platforms, recording offices, signers, or other parties outside our reasonable control, including weather, outages, and emergencies.
Acceptable use
You agree not to:
- use the Site for anything unlawful, fraudulent, or harmful;
- give false information or impersonate any person or company;
- scrape, copy, or harvest the Site or its content with bots or other automated means;
- probe, scan, or test the Site's security, or interfere with its operation;
- upload or send malicious code, spam, or unsolicited advertising through the Site; or
- use the Site or its content to build or support a competing service.
Intellectual property
The Site and its content, including text, design, photographs, video, graphics, and the AmeriTex Notary name and star logo, are owned by or licensed to AmeriTex and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your own use in connection with our services. You may not copy, modify, republish, sell, or create derivative works from any part of the Site without our written permission.
Feedback
If you send us ideas or suggestions about the Site or our services, we may use them without any obligation to you.
Third-party sites and services
The Site links to sites and services we do not control, such as notary recruiting sites, remote online notarization platforms, and shipping carriers. Those sites have their own terms and privacy policies. A link is not an endorsement, and we are not responsible for third-party content, practices, or availability.
Third-party names and trademarks
The Site may mention other companies and their products or services, such as shipping carriers, technology platforms, and recruiting sites. Those names, logos, and trademarks belong to their owners. We mention them only to identify services we use as a customer or subscriber, or that you may encounter in connection with our services. A mention or link does not mean that company endorses, sponsors, or is affiliated or partnered with AmeriTex, or that we endorse it.
Electronic communications
When you use the Site or contact us, you consent to receive communications from us electronically. You agree that notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.
Calls and text messages
- When you or your title company, lender, or agent gives us a phone number for a request or an order, you consent to receive calls and text messages from AmeriTex and your assigned notary about that request or order, such as scheduling, confirmations, arrival updates, document questions, and follow-up. This consent applies once an order is accepted, whether the messages come through our systems or directly from your notary.
- You can stop text messages at any time by replying STOP, or by telling us or your notary. Message and data rates may apply, and message frequency varies by order.
- We do not send marketing text messages unless you separately agree to receive them.
Legal disclaimer
Nothing on the Site is legal advice. AmeriTex, its notaries, and other attorneys involved in a transaction do not represent you unless that has been arranged in a separate written agreement, and any legal advice must come from your own attorney. Please read our full Legal Disclaimer.
Disclaimer of warranties
The Site and all content on it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on it is complete or current.
Limitation of liability
To the fullest extent permitted by law, AmeriTex and its owners, employees, notaries, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising out of or related to the Site or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to your use of the Site will not exceed one hundred dollars ($100).
Some states do not allow certain limitations, so some of the above may not apply to you. Liability for services we perform for you is governed by the agreement for those services.
Indemnification
You agree to defend, indemnify, and hold harmless AmeriTex and its owners, employees, notaries, and agents from any claims, losses, liabilities, and expenses, including reasonable attorney's fees, arising out of your use of the Site, information you provide, or your violation of these Terms, the law, or anyone else's rights.
Dispute resolution and arbitration
- Talk to us first. Before starting any formal proceeding, send us a written description of the dispute by mail at the address below. Both sides will try in good faith to resolve it within 30 days.
- Binding arbitration. If it is not resolved, any dispute arising out of or relating to the Site or these Terms will be resolved by final, binding arbitration before a single arbitrator administered by the American Arbitration Association under its applicable rules, and governed by the Federal Arbitration Act. Arbitration will take place in Tarrant County, Texas, or remotely if the arbitrator allows.
- Exceptions. Either side may bring an individual claim in small claims court, and either side may seek an injunction in court to protect intellectual property or stop misuse of the Site.
- No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding. You and AmeriTex each waive the right to a jury trial.
- Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas.
Age requirement
The Site is intended for adults 18 and older. We do not knowingly collect personal information from children under 13.
Termination
We may suspend or end your access to the Site at any time, for any reason, without notice. The sections on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive.
Changes to these Terms
We may update these Terms at any time by posting a new version on this page with a new effective date. Continuing to use the Site after a change means you accept the updated Terms.
General
These Terms are the entire agreement between you and AmeriTex about the Site. If any provision is found unenforceable, it will be enforced to the maximum extent allowed and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. No partnership, employment, or agency relationship is created by these Terms or your use of the Site. These Terms are written in English, and the English version controls.
