This Privacy Policy explains how AmeriTex Notary LLC ("AmeriTex," "we," "us," or "our") collects, uses, shares, and protects personal information through ameritexnotary.com (the "Site") and when we provide mobile and remote online notary and closing services. If a client agreement covers how we handle information for a specific transaction, that agreement also applies.

The short version: we collect what we need to answer your request and perform your closing, we share it only with the people and providers involved in that work, and we do not sell your personal information or share it for targeted advertising.

Information we collect

Information you send through the Site

Your name, company, email address, phone number, property state or territory, signing type, expected closing date, transaction type, and anything you write in the details field.

Information we handle to perform services

When we perform a signing, we receive information from our clients (such as title companies, lenders, and escrow offices) and from signers. This may include names, contact details, property addresses, closing documents, signatures, the type, number, and expiration of identification documents, and entries in the notary's record book.

For remote online notarizations, the platform and its identity verification provider may also collect a Social Security number or other identifying details to generate knowledge-based questions, an analysis of your identification document, and an audio and video recording of the session, as state law requires.

Information collected automatically

Like most websites, our hosting provider records basic technical data when you visit, such as your IP address, browser and device type, pages viewed, the referring page, and the date and time. Our fonts are loaded from Google Fonts, which receives your IP address when the Site loads.

We do not use advertising cookies or tracking pixels. See "Cookies and analytics" below for how we handle analytics.

Information from partners

When we review notaries for our network, we may receive profile and credential information that they choose to share with us through a third-party notary recruiting site.

How we use information

  • To respond to your questions and quote requests.
  • To schedule, perform, document, and return signings and notarizations.
  • To verify identity and meet the legal requirements for notarial acts.
  • To send confirmations and updates about an order to the people involved in it.
  • To prevent fraud, protect our clients and signers, and secure the Site.
  • To comply with the law, respond to legal process, and keep business records.
  • To send occasional updates to business contacts, which you can opt out of at any time.

How we share information

We share personal information only as needed to do the work you or our clients request, and only with:

  • Parties to the transaction, such as the title company, lender, escrow office, real estate agent, or attorney handling the file, as they direct;
  • Notaries assigned to the signing;
  • Remote online notarization platforms and identity verification providers;
  • Shipping carriers, such as UPS and FedEx, to return documents;
  • Service providers who host the Site, deliver email, or support our systems, under confidentiality obligations;
  • Authorities and others when required by law, subpoena, or court order, or when needed to prevent fraud or protect someone's safety or rights; and
  • A successor in a merger, acquisition, or sale of our business, subject to this policy.

We do not sell personal information, and we do not share it for targeted advertising or profiling.

Notary records and session recordings

State law requires notaries to keep a record of each notarial act, and, for remote online notarizations, to keep the audio and video recording of the session, for set periods of time. We keep these records for as long as the law requires, even if you ask us to delete your information. In some states, including Texas, entries in a notary's record book may be available to the public on request as provided by law.

Financial information

Much of the information we receive from lenders and title companies is protected under the Gramm-Leach-Bliley Act and similar laws. We use it only to perform the services requested and protect it as required by law and by our agreements with those clients.

Sensitive information

We handle sensitive information, such as government identification and Social Security numbers, only as needed to verify identity and complete notarial acts as the law requires. Please do not send sensitive information through the Site form or by ordinary email. If it is needed, we will tell you how to send it securely.

How long we keep information

We keep personal information only as long as needed for the purposes described here, or longer when the law requires it, such as for notary records, session recordings, and tax and business records. Inquiries that do not lead to business are deleted or de-identified once we no longer need them.

How we protect information

We use encrypted connections (HTTPS), limit access to the people who need it, require service providers to keep information confidential, and use secure platforms for remote online notarizations. No system is completely secure, so we cannot guarantee the security of information sent over the internet.

Your privacy rights

Depending on where you live, including under the Texas Data Privacy and Security Act, you may have the right to:

  • confirm whether we process your personal information and get access to it;
  • correct inaccurate information;
  • delete information you provided or that we obtained about you;
  • get a copy of your information in a portable format; and
  • opt out of the sale of personal information, targeted advertising, and certain profiling. We do not do any of these.

How to make a request: use the form on our home page, choose Ask a question, and start your message with "Privacy request," or write to us at the address below. We will verify your identity before acting, and we will respond within 45 days. If we need more time, we will tell you, and we may extend that period once by up to 45 more days.

Appeals: if we decline your request, you may appeal by sending a message that starts with "Privacy appeal." We will respond within 60 days. If your appeal is denied, you may contact the Texas Attorney General.

Some information cannot be deleted because the law requires us to keep it, such as notary records and session recordings. We will not discriminate against you for exercising your rights.

Calls, texts, and email

When you, or your title company, lender, or agent, give us your phone number or email address for a request or an order, our team and your assigned notary may call, text, or email you about it, including scheduling, confirmations, arrival updates, and follow-up. Once an order is accepted, these messages may come from our systems or directly from your notary.

You can stop text messages at any time by replying STOP or by telling us or your notary. Message and data rates may apply. We do not send marketing text messages unless you separately agree to receive them, and you can opt out of marketing email at any time using the link in the message.

Cookies and analytics

The Site stores a small setting in your browser to remember your cookie choice. With your consent, we may also use analytics tools, such as Google Analytics, to understand how visitors use the Site, for example which pages are viewed and how visitors arrive. Analytics only run if you choose Accept on the cookie banner. You can change your choice at any time with the Cookie settings link at the bottom of every page, and you can also block or delete cookies in your browser settings.

Do Not Track and Global Privacy Control

If your browser sends a Global Privacy Control signal, we treat it as a choice to decline analytics. We do not track visitors across other websites, and we do not sell or share personal information for advertising.

Children's privacy

The Site is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child has sent us information, contact us and we will delete it.

Other websites

Links to other sites, such as notary recruiting sites, remote online notarization platforms, and shipping carriers, are governed by those sites' own privacy policies.

Where information is processed

We are based in the United States, and information is processed and stored in the United States.

Changes to this policy

We may update this policy from time to time. We will post the new version on this page with a new effective date, and we will place a notice on the Site when changes are significant.
